FAQ

Please read this entire FAQ carefully before contacting us. We worked hard on this, and believe this will answer most, if not all, of your questions. If you email us with a question that is on this list, you will not get a response back. Thank you!

Is it okay that I've already filed/disputed my ticket?

Yes, that is fine. Please complete the form, and indicate that you’ve already filed/disputed it in the appropriate section.

My friend/relative got a ticket. Can I submit theirs too?

No. All tickets must first be authorized by Victoria at Rebel News. You can reach her at [email protected]

Do I really need to submit your form?

Yes, you must submit a form entry for every ticket you received, even if you already gave information to Rebel News. If you do not submit a form for each ticket, we won’t have the information we need to represent you. If we don’t get your form within 30 days of our first email to you, we will close your file.

Where do I submit my form?

If you have not already submitted your form, please do so HERE.

Keep in mind:

  • This form must be submitted for each ticket you have. For example, if you have two tickets, you will fill out this form twice.
  • Read the instructions for the province that gave you your ticket before filling anything out.
  • Make sure the photos you upload are clear and focused. They must not be blurry or cut off.
  • Triple check the information you submit. The wrong information will hurt your case.
I submitted my form. Now what?

If you submitted it properly, you’ll get an automatic confirmation email. If you don’t see it, check your spam folder. If you don’t hear from us for a while afterwards, it’s a good sign. It means you filled it out properly.

If you have filed/disputed your ticket on your own, you MUST let us know when you get a court date. We won’t know unless you tell us.

If you did not file your ticket, and it was issued by Ontario, we will file it for you. You can assume that we are filing it within the time limit. We’ll send you a text message confirmation that it’s been done. Please be patient. The text message will eventually arrive. Please don’t ask us if we’ve filed your ticket.

If you did not file your ticket, and it was issued outside of Ontario, you must file/dispute the ticket on your own. We will continue the process after that. Let us know when you get a court date.

If you have a court date scheduled, assuming you put it in the form, we will attend for you. You do NOT need to attend it. And we won’t be letting you know we are attending; you can assume we are. Please don’t ask us beforehand.

I’m having trouble submitting the form, what should I do?

Try submitting it again. Make sure you’re submitting just ONE photo of your ticket, and ONE photo of your ID in each form – the form won’t accept more than one file of each. If you still see an error message, check what the error is on the page, and follow the instructions. If you still have trouble, let us know.

Why do I need to send you my ID?

We are required to have photo ID for every client, pursuant to the Law Society rules. Don’t worry, we won’t share it with anyone.

Why is it taking so long to get a court date?

Courts are slow in the best of times, and COVID has certainly slowed things even more. Don’t worry, this is normal, and there’s nothing we can do to make things go quicker. In fact, this may turn into a legal argument — we will have to see and base it on a case by case basis.

Why haven’t you requested my disclosure/evidence yet? When will you request it?

In most cases, strategically, we wait until after your first court appearance to request disclosure (i.e. evidence). If your first court appearance passed, and it still hasn’t been requested, give us a bit of time, and it will be requested.

Why haven’t you requested a resolution meeting yet?

Every court and every case is different– some courts force a resolution meeting as the first step, and some can only be requested once the first court appearance has passed. Some prosecutors are not open to resolving some charges, so booking a resolution meeting does not make sense.

To make things more complicated, some courts have formal resolution meetings set, like a court date, and some are informal over the phone or email discussions. If your first court appearance passed, and it still hasn’t been requested, give us a bit of time, and it will be requested at the appropriate time.

It says you received my disclosure. I want to see it now.

We’ll let you know when we review it, and only then will we discuss it with you. We want to be sure we are valuing your time and our time by giving you the accurate information you need. Please do not rush this process as we want to make sure we review it properly.

It says you had a resolution meeting. What happened?

We’ll be in touch with you to tell you about it. Hang on a bit longer — we may still be negotiating to get the best “deal” for you!

Why was a trial requested before a resolution meeting?

It’s likely that the “request a trial” option was initially selected when deciding to fight the ticket. It’s also possible that the court selects that option by default when someone decides to fight a ticket. Don’t worry. We will be sure to hold a resolution meeting before the trial– either a formal one with a date, or an informal meeting via phone or email.

I was told my ticket was not found in the court system. Why does the text message say that it was filed?

Even though your ticket was not found, we still manually file your ticket by email to the court. We do this as a safety precaution to ensure you aren’t convicted, and as a strategy, to get the court clerks to send a letter confirming that your ticket does not exist.

Do I need to attend court? My ticket says I have to.

No. You do NOT need to attend court in any way unless we ask you to. If we do not ask you to attend, you can assume that you do not need to. As your representatives, we will attend for you. We won’t be letting you know beforehand that we are attending for you. You can assume we are.

I'm nervous about my case! Are you sure you're going to attend court? Do you have it in your calendar?

Yes, we will attend court, and yes we have it in our calendar. We understand that you feel anxious, but don’t worry – we have things under control. This is what we do all day, every day! We have your back and we are taking care of your matter FOR YOU.

What happens in the court process?

Your court case has two stages. 

STAGE 1 is where you try to resolve things without a trial. Think of it as a negotiation or mediation phase. Even though this stage involves a courtroom and a judge, it is NOT a trial. Your initial court appearances will be in this stage. It is during this stage that we ask for all the evidence (i.e. disclosure) so that we can defend you properly. It is during this stage that we speak to the prosecutor, and possibly a judge, to try to resolve things. It is normal for STAGE 1 to have many court appearances. The majority of the time, we will keep adjourning the case, which basically means we will tell the judge that we’re still trying to resolve things with the prosecutor, and need more time. So the judge will keep giving us a new court date. Rinse and repeat.

STAGE 2 is a trial, and this rarely happens. If it does happen, it’s much later on. There’s a high chance that your case will be resolved in the first stage.

I’m going to use an analogy to better explain things to you. Imagine you are in school, and get into a fight with a classmate. The teacher tells you to work it out amongst yourselves. However, the teacher will keep checking in with you guys to make sure you’re making progress. This is very similar to STAGE 1. The classmate is the prosecutor, and the teacher is the judge. The teacher checking in with you and your classmate is like the judge checking in with you and the prosecutor to find out if things are progressing.

If you and your classmate decide that you haven’t made progress, then the teacher can take you guys to the principal’s office to have him/her decide the outcome for you guys. This is very similar to STAGE 2 – the trial. The principal is like the trial judge.

What happens at my first court appearance?

Nothing significant. No issues will be decided. This is not a trial. This is part of STAGE 1. The purpose of this appearance will be to say to the judge: “hello, we are pleading not guilty, let’s start the process of trying to resolve things without a trial.”

Why are there so many court appearances? I want this done on the first date!

It takes time to collect all of the evidence (called disclosure), and meet with the prosecutor to try to resolve things. We want to make sure no stone is left unturned. It is a much better strategy to go slowly, than to rush things.

Will the court be contacting you or me?

Every situation is different. Just be on the lookout for court notices because lots of courts prefer to send correspondence ONLY to the defendant. If you do not forward any mail you receive, we may not know about it!

How long will this case take to be done?

Typically, it could take anywhere from a few months to two years.

I want to speak to someone about my case!

It’s NOT productive to speak about your case BEFORE we get the disclosure. Let’s wait until after we get it, so that we know exactly what we’re up against. At that point, we can speak. Don’t worry, there will be plenty of time.

What are my chances of winning?

We won’t know until we review your disclosure. Based on what we learn, we will choose the best defences and strategies.

When will I get updates?

You will get weekly SMS text updates from us to your cell phone. If something in your case happened, like a court appearance or a meeting with a prosecutor, give us a few days to let you know what happened. For example, if you had a court appearance today, we’ll text you with an update within the next few days. Do not contact us on that day or the next day asking for an update. Please keep in mind that we are handling hundreds of cases. If you haven’t heard from us, please be patient.

I received some court notices or documents that I want to send to you. How do I send them?

You can share the documents by uploading them HERE. Do not email them or text them. You also don’t have to let us know that you received them or that you are sending them — we will get a notification.

I have a new address or phone number. What do I do?

Email us with the new information.

Am I allowed to leave the province or country?

Yes. This is not a criminal charge. Also, you are innocent until proven guilty.

Will this affect my immigration status?

No. This is not a criminal offence.
